Release of Liability 

 

Mentoring is a service that provides personal mentoring, guidance and support to specific individuals and/or groups. The Client is aware that mentoring is in NO WAY to be construed or substituted as psychological counseling or any other type of therapy or medical advice. The Real Change With Bec, all Mentors and all other employees or associates will at all times exercise their best professional efforts, skills and care of ensuring a client is mentored to meet their mentorship goals, the Client understands and acknowledges the Mentor will not be liable legally or otherwise for the actions the Client may or may not undertake as a result of the mentoring sessions. No assumptions of responsibility is made or given and the Client requesting such advice agrees not to hold The Real Change With Bec (provider) and/or any employees associated with The Real Change With Bec responsible or liable in any form or fashion for such actions taken on their own accord. The method and process in which this advice and direction are given in no manner whatsoever, written or verbal, constitutes and agreement or liability on the part of the provider and is acknowledged to be different in many ways than clinical and medical counseling. 

 

You (the Client) agree that using any of these mentoring services is entirely at your own risk. Mentoring services are provided “as is” without any warranty of any kind, either expressed or implied, including without limitation any warranty for information services, mentoring, uninterrupted access or products and services provided through or in connection with the service. This service is requested at the Client’s own choice and with inherent singular responsibility. Any actions or lack of actions, taken by the Client of such advice, is done solely by choice and responsibility of the Client is neither the responsibility nor liability of The Real Change With Bec and/or any employees or any other persons/Mentors associated with The Real Change With Bec. The Client takes full responsibility for the decisions they make after being mentored as well as the consequences. The Client enters into mentoring with a full understanding that YOU (the Client)  are RESPONSIBLE FOR CREATING YOUR OWN RESULTS. Periodically your Mentor may provide links to other websites or content that may be of value, interest or convenience to you (the Client). This does not constitute an endorsement of material at those sites or any associated organization product of service. It is the responsibility of the user to make their own informed decision about the accuracy of the information on those sites and print material including their privacy policies. In no event shall The Real Change With Bec (the Provider) and/or any employee or other persons/Mentors associated with The Real Change With Bec be liable for any incident or consequential damages resulting in the use of the material. 

 

Limited Liability 

 

Except as expressly provided in this agreement, The Real Change With Bec makes no guarantees or warranties, express or implied. In no event will The Real Change with Bec and/or Mentors, employees and others associated with The Real Change With Bec be liable to the Client for consequential or special damages. Notwithstanding any damages that the Client may incur, The Real Change With Bec’s entire liability under this agreement and the Client’s exclusive remedy will be limited to the amount paid by the Client to The Real Change With Bec under this agreement for all services rendered up until the termination date. 

 

This is the entire agreement of the parties and reflects a complete understanding of the parties with respect to the subject matter. This agreement supersedes all prior written agreements, oral representations, discussions or understandings. 

 

If a dispute arises out of this agreement that cannot be resolved by mutual consent, the Client and The Real Change With Bec and/or Mentor agree to attempt to mediate in good faith for up to thirty (30) days after notice is given. If the dispute is not resolved and in the event of legal action, the prevailing party shall be entitled to recover attorney’s fees and court costs from other party.

​​​​Confidentiality

 

This Mentoring relationship, as well as information (documented or verbal) that the Client shares with The Real Change With Bec and/or the Mentor as a part of this relationship is bound to confidentiality by the ICF Code of Ethics but is not considered a legally confidential relationship (as in Medicine or Law). The Real Change With Bec/Mentor agrees not to disclose any information pertaining to the Client without the Client's written consent. The Real Change With Bec and/or Mentor will not disclose the Client’s name as a reference without the Client’s consent. Confidential information does not include information that: (a) was in The Real Change With Bec and/or Mentor’s possession prior to it’s being furnished by the Client; (b) is generally known to the public or in the Client’s industry; (c ) is obtained by The Real Change With Bec and/or Mentor from a 3rd party, without breach of any obligation to the Client; (d) is independently developed by The Real Change With Bec and/or Mentor without use or reference to the Client’s confidential information; or (e) the The Real Change With Bec and/or Mentor is required by law to disclose.
